1. Introduction
Welcome to Healthy Africa (the “Site”), operated by Prohealth.Africa (“Healthy Africa”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of the Site, any mobile applications, products, services (including telemedicine or remote consultation services) and content provided by Healthy Africa (collectively, the “Services”). By accessing or using the Services you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Services.
These Terms form a binding legal agreement between you and Healthy Africa. If you are using the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
Note: These Terms do not replace the Medical Disclaimer, Privacy Policy, or other specific consent forms and service-specific agreements (for example, telemedicine consent). Those documents are incorporated by reference and together with these Terms form the agreement between you and Healthy Africa.
2. Definitions
- User/You: any person or entity who accesses or uses the Site or Services.
- Content: text, images, videos, downloads, protocols, articles, clinical resources, and other material available on the Site.
- User Content: content uploaded, posted, or submitted by users (comments, forum posts, case stories, questions).
- Telemedicine/Remote Consultation: any clinical consultation or medical advice delivered remotely via telecommunication technologies offered directly by Healthy Africa or through its authorized clinicians.
3. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to register for an account, use paid Services, or enter into legally binding agreements on the Site. If you are using the Services on behalf of a minor or person lacking capacity, you must be their legally authorized representative and comply with applicable laws and these Terms.
4. Account registration and security
If you create an account, you agree to provide accurate and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. 5.1 License to use the Site
Subject to your compliance with these Terms, Healthy Africa grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes and to access publicly available Content.
5.2 Prohibited conduct
You agree not to:
- Use the Services in a way that violates applicable laws or professional regulations.
- Post or transmit illegal, harassing, defamatory, obscene, pornographic, hateful, or violent content.
- Impersonate another person or misrepresent your affiliation.
- Upload viruses, malware, or any code that disrupts the Site.
- Attempt to gain unauthorized access to restricted areas of the Site or other users’ accounts.
- Harvest or scrape the Site’s content or user data without written permission.
- Use the Site for commercial solicitation without our prior written consent.
We reserve the right to remove User Content and restrict or terminate accounts that violate these rules.

By submitting User Content you grant Healthy Africa a perpetual, worldwide, non-exclusive, royalty‑free license to use, reproduce, distribute, adapt, publish, translate, and display such User Content in connection with our Services and promotional activities, in any media now known or later developed. You represent and warrant that you have all rights necessary to grant this license.
6.2 Moderation and removal
We moderate User Content and may remove or disable access to any content that breaches these Terms or our community guidelines. We are not responsible for User Content and have no obligation to publish or store it.
6.3 Personal stories and case details
If you share personal health information or stories, do not include personally identifiable details unless you consent to publishing them and have the necessary permissions from other parties involved. We may require written consent before publishing personal stories.
7. Clinical content, telemedicine, and limitations
7.1 Educational content
Content on the Site is provided for informational and educational purposes only and is not intended as medical advice. See our Medical Disclaimer for full details.
7.2 Telemedicine and remote consultations
If you book a telemedicine consult through Healthy Africa, the consultation is subject to additional terms, a telemedicine consent form, and our privacy practices. By booking a consultation you represent that you are legally permitted to receive medical services in the jurisdiction where you are physically present during the consultation.
Clinicians providing telemedicine services are licensed or credentialed where required; however, availability of clinicians and the permissibility of remote prescribing vary by jurisdiction. We may decline to provide remote services where prohibited by law or where a clinician deems in‑person assessment necessary.
7.3 Prescriptions and clinical decisions
Any prescribing decision is made at the discretion of the treating clinician and is subject to applicable laws and platform policies. Healthy Africa does not guarantee that prescriptions will be provided. You must follow the clinician’s instructions and seek emergency care when needed.
7.4 No emergency service
Healthy Africa is not an emergency medical service and should not be used for urgent or life‑threatening conditions. If you are experiencing a medical emergency, contact local emergency services immediately.
8. Payments, fees, and refunds
8.1 Pricing and payments
Certain Services may require payment. Fees, billing schedules, and refund policies are described on the Site at the point of purchase. By purchasing Services you authorize us to charge the provided payment method for the stated fees.
8.2 Refunds and cancellations
Refunds and cancellations are subject to our refund policy which will be posted where relevant. For telemedicine, cancellations within a short window before the appointment may not be refundable. We reserve the right to modify payment terms for specific services.
8.3 Taxes
You are responsible for any taxes, duties, or other governmental charges associated with purchases.
9. Intellectual property
9.1 Our IP
All Content and materials on the Site, including text, graphics, logos, icons, audio clips, video clips, and software, are owned or licensed by Healthy Africa and are protected by copyright, trademark, and other intellectual property laws.
9.2 Trademarks
“Healthy Africa”, “Prohealth.Africa” and our logos are trademarks of Healthy Africa. You may not use these marks without our prior written permission.
9.3 Your use of Content
You may view, download, and print Content for your personal, non-commercial use, provided you keep all proprietary notices intact. Any other use, including reproduction, distribution, modification, or public display, requires our prior written consent.
10. Links to third‑party sites
The Site may contain links to third‑party websites and resources. We do not control, endorse, or assume responsibility for third‑party content, products, or services. Your use of third‑party sites is at your own risk.

13. Disclaimers — no warranties
To the fullest extent permitted by law, the Site, Services, and Content are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error‑free, or free of harmful components.
14. Limitation of liability
To the maximum extent permitted by applicable law, Healthy Africa and its affiliates, officers, employees, contractors, agents, licensors and service providers will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages (including loss of profits, data, goodwill, use, or other intangible losses), even if advised of the possibility of such damages, arising out of or relating to these Terms, the Site, or Services.
Our total aggregate liability for all claims related to the Site or Services shall not exceed the total amount paid by you to Healthy Africa for the specific Service that gave rise to the claim in the 12 months preceding the claim. If no fees were paid, our liability is limited to a nominal amount to the extent permitted by law.
These limitations may not apply to the extent prohibited by law.
15. Indemnification
You agree to indemnify, defend, and hold Healthy Africa and its officers, directors, employees, contractors, agents, licensors and affiliates harmless from and against any claims, liabilities, losses, damages, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your User Content, your violation of law, or your use of the Site.
16. Termination and suspension
We may suspend or terminate your access to the Site or Services, with or without notice, for violations of these Terms or for any other reason. Sections that by their nature should survive termination (for example, Intellectual Property, Disclaimers, Limitation of Liability, Indemnity, Governing Law) will continue in effect after termination.

By creating an account or subscribing to our newsletter, you consent to receive communications from Healthy Africa, including newsletters, service updates, and promotional materials. You may opt out of marketing communications at any time using the unsubscribe mechanism in our emails or by contacting contact.healthyafrica@gmail.com. Transactional and service-related communications may still be sent.
21. Consumer rights and refunds (where applicable)
If you are a consumer in a jurisdiction with statutory consumer protection rights, those rights are not affected by these Terms. Refund, cancellation and distance selling rights will be applied in accordance with applicable local laws.
22. Severability and waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Failure by Healthy Africa to enforce any right or provision will not constitute a waiver of such right or provision.
23. Entire agreement
These Terms, together with our Privacy Policy, Medical Disclaimer, and any service‑specific consent forms, constitute the entire agreement between you and Healthy Africa regarding the Services, superseding any prior agreements.
